INNOCENT UNTIL PROVEN GUILTY

The presumption of innocence is a legal principle that every person accused of any crime is considered innocent until proven guilty.

On the other hand, I would like to submit the notion that all tailings are to be considered liquefiable until proven otherwise beyond the shadow of doubt. 

Why?

Well, it’s just generally in their nature.  Generally.  Liquefiable soils are generally (there’s that word again) young, loose, saturated non-clay-like materials.  (Footnote:  I’ll discuss what happens to clayey soils under strong cyclic shaking elsewhere; they aren’t altogether innocent).

Getting back to the point… yes, I know that some tailings can be quite dense due to factors such as desiccation and whatnot.  I am talking in general terms. 

Young, loose, saturated non-clay-like materials pretty much define tailings.  Generally.

To prove this otherwise, you would need strong evidence, backed by a considerable amount of science and from multiple perspectives. 

This is the opposite of the presumption of innocence.
